Except as expressly set forth herein, Brahma Engineering (dba WVO Designs) and its employees or agents [jointly or severally the "Seller"] shall not be liable for any damage, expense, or liability resulting from the sale, use or misuse of, or the reliance on any product, materials, goods or information supplied by Seller (collectively the "Product") purchased or used by any original or subsequent purchaser or user (jointly or severally the "Buyer"). In no event shall Seller be liable for any special, incidental, indirect or consequential damages of any kind or nature, regardless of whether or not the Buyer of the Product was advised of the possibility of damage or harm arising or resulting from the use or performance of the Product, and by reading these warranty terms on Seller's web site or elsewhere, or by purchase or use of the Product, the Buyer hereby expressly waives the right to any and all such claims.

By purchasing or using the product, Buyer acknowledges and agrees that he/she is not relying on Seller's skill or judgment to select or furnish the Product or any goods suitable for any particular purpose, and Buyer hereby expressly waives all remedies or liabilities, expressed or implied, arising by operation of law or otherwise, including, without limitation, any obligation of Seller regarding any merchantability or fitness of the Product for any particular purpose; the Buyer hereby expressly waives liability for any special, incidental, indirect or consequential damages following purchase or use of the Product, regardless of whether or not such were occasioned by Seller's negligence.

Except as expressly stated otherwise herein, Seller disclaims any warranty or any liability for personal injury or damages following Buyer's use of the Product. Buyer expressly acknowledges and agrees that this disclaimer of any liability for personal injury is a material term of any warranty and Buyer hereby indemnifies and holds Seller harmless for any claim related to the Product and its use or performance. Under no circumstances shall Seller be liable for any damages, liabilities, costs or expenses incurred as a result of the sale, use or performance of the Product including, without limitation, any damages, liabilities, costs or expenses incurred by reason of Buyer's negligence related to the sale or use of the Product.

The Buyer hereby acknowledges and agrees that proper installation and use of the Product is the sole responsibility of the Buyer, and the Seller assumes no responsibility or liability regarding installation, misuse or misapplication of the Product.

In the event that the Buyer does not agree with the terms of the warranty, the Buyer shall promptly return the Product, in new and unused condition, with a dated proof-of-purchase, to the original place of purchase within thirty (30) days from date of purchase for a full refund. The Buyer hereby expressly agrees that any installation of the Product shall confirm that Buyer has read, fully understands and agrees to the terms and conditions herein.
